Time of Reading 3:25 to 3:30 P. M. Eastern Standard Time. …, N.Y. (Fred Seely and [257], in Room 16-P, Waldorf Astoria Hotel, N.Y.C. Seely has requested [257] to make effort to get a settlement at St. Louis, and explained his personal conditions in Asheville in relation to the banks, etc. What can [257] do, considering all conditions around the present suit set for trial Dec. 7th at St. Louis, to assist Seely in settlement?)

  1. EC: Yes, we have those conditions, those circumstances that are in activity.

  2. As we find, considering the situations, while they may be placed before those that are defending - and that are active in prosecuting the suit, these are the only channels that would be reasonable and correct for [257] to take in the present. Or let Seely, rather than presenting his desires in the matter, present those to REID and to those that represent [257]; for these having been set may be used against the whole situation in opposition to the best interests of those who have taken the conditions or the case in presenting same.

  3. These, as we find, would be the manners for this to be handled. If this is to release or to make for a settlement in such a manner, not necessary that it go through its whole proceedings - IF presented to the proper channels; for these are those to be taken into consideration, or have troubles later.

  4. (Q) Is the proposal by Olvaney, Eisner & Donnelly made in good faith for benefit of [257] & Seely? (A) As we find, we would take these to their PROPER channels - to [257]‘s attorneys, rather than considering them either as individual activities. For these will only necessarily make for complications, even considering whether in good faith or whether to see what may be accomplished.

  5. (Q) Seely is going to see Isaac Orr at the St. Louis Union Trust Co., to ask Orr to cooperate. What suggestion should Seely make to Orr as to the fair handling of this matter? (A) This will be well, if it will be presented to Reid also.

  6. (Q) Should [257] go to St. Louis with Seely without attorneys on either side present? (A) If this is to be presented to Reid. This has been given again and again. It CANNOT, for the best interests of [257], be settled properly without considering Reid’s attitude who is in charge. DO it!

  7. We are through.
